Back Injuries from Slip and Fall Accidents in California

A back injury from a slip and fall is among the most common and most contested outcomes of slip and fall accidents in California. A fall can herniate discs, fracture vertebrae, or damage the facet joints and surrounding soft tissue in ways that are not immediately apparent but become disabling over time.

Under California Civil Code § 1714, property owners have a legal duty to maintain reasonably safe premises. When a hazardous condition causes a visitor to fall and sustain spinal or back injuries, the owner may be held liable for medical expenses, lost wages, pain and suffering, and future rehabilitative care.

Common Causes of Slip and Fall Accidents

California property owners and managers are required to keep their premises in a reasonably safe condition. Slip and fall back injuries frequently result from the property owner’s failure to remedy a known hazard. These may include:

  • Broken tiles. Cracked or missing tile creates uneven walking surfaces that catch a foot mid-stride, sending the body into a sudden, uncontrolled fall that concentrates impact force on the lumbar spine.
  • Debris in walkways. Boxes, merchandise, cables, or other obstructions left in pedestrian paths are a frequent cause of trip-and-fall incidents, particularly in retail and warehouse environments.
  • Inadequate lighting. Poorly lit stairwells, parking structures, and corridors prevent pedestrians from detecting hazards underfoot, making the property owner’s failure to maintain adequate lighting a basis for liability.
  • Loose floorboards. Warped, shifting, or improperly secured flooring in older buildings creates an unpredictable walking surface that can cause an abrupt fall with little warning.
  • Torn carpeting. Frayed edges, bubbling, or separated seams catch the toe of a shoe and pitch the body forward, often with enough force to cause herniated discs or vertebral compression fractures.
  • Wet floors. Spills, mopping, or tracked-in rainwater without adequate warning signage remain one of the most common premises liability hazards in California courts.

When a property owner had actual or constructive notice of any of these conditions and failed to act, that failure can establish the negligence at the core of your claim.

Serious Slip and Fall Back Injuries

The most common serious slip and fall back injuries include:

Herniated discs

The spinal discs act as shock absorbers between vertebrae, each consisting of a tough fibrous outer ring surrounding a gel-like interior nucleus. In a slip and fall, the sudden compressive or rotational force can tear the outer ring, allowing the interior nucleus to push through and compress adjacent nerve roots. This produces pain, numbness, tingling, or weakness that can radiate into the legs.

Conservative treatment, such as physical therapy, anti-inflammatory medication, and epidural steroid injections, resolves symptoms in many patients. When it does not, a microdiscectomy or minimally invasive decompression procedure may be indicated.

Severe disc damage or structural instability may require spinal fusion or artificial disc replacement, both of which carry longer recovery timelines and no guarantee of full pain resolution.

Lumbar Strains

The lumbar spine bears the majority of the body’s weight and is particularly vulnerable to the sudden, uncontrolled movement of a slip and fall. When the body loses footing, the instinctive effort to catch the fall can wrench the muscles and ligaments of the lower back beyond their normal range of motion. This can cause tears in the soft tissue that stabilize the spine. The result is localized pain, muscle spasms, stiffness, and reduced range of motion that can persist well beyond the initial injury.

Most lumbar strains respond to conservative treatment: rest, ice, anti-inflammatory medication, and physical therapy. However, recovery can take weeks to months, depending on severity. Persistent or recurring symptoms may require imaging to rule out underlying structural damage that an initial strain diagnosis would not capture.

Vertebral Fractures

The vertebrae are the bones that form the spinal column. While they are built to withstand considerable load, the sudden impact of a slip and fall can fracture them, particularly in the lower and mid-back where compressive forces are greatest.

The most common is a compression fracture, in which the front of a vertebra collapses under impact. Older patients or those with reduced bone density are at heightened risk; a relatively minor fall can fracture a spine that age or osteoporosis has already weakened.

Stable fractures are typically managed conservatively with bracing, activity restriction, and pain management. When a fracture is unstable or threatens the spinal canal, surgery may be required to prevent further collapse or neurological damage.

Spinal Cord Injuries

The spinal cord is the bundle of nerves that runs through the spinal column and carries signals between the brain and the rest of the body. A slip and fall can injure the spinal cord directly through trauma, or indirectly through bleeding or swelling that builds pressure on the cord.

The consequences depend on the location and severity of the injury; damage higher on the cord affects more of the body, and range from partial loss of sensation or motor function to complete paralysis below the injury site.

Spinal cord injuries are classified as incomplete, where some function below the injury level is preserved, or complete, where motor and sensory function is entirely lost. The most severe outcomes are paraplegia, paralysis of the lower body, and quadriplegia, which affects all four limbs and can impair breathing.

Spinal cord injuries require emergency medical intervention and typically involve long-term or lifelong care, including surgery, rehabilitation, assistive technology, and attendant support.

Legal Implications of Serious Back Injuries

Serious back injuries significantly increase the value and complexity of a personal injury claim. The long-term cost of care, including surgery, inpatient rehabilitation, pain management, and ongoing physical therapy, can be substantial.

California courts recognize the full scope of these damages, including future medical expenses and loss of earning capacity. Because the stakes are high, insurance carriers mount aggressive defenses, disputing causation, challenging injury severity, and scrutinizing any prior medical history that might support a pre-existing condition argument.

At Salamati Law, we have the resources and litigation experience these claims demand. If a negligent property owner caused your back injury, we will pursue the full compensation you are entitled to, and we do not collect a fee unless we win. See our case results here

Slip and Fall Compensation

California law entitles slip and fall victims to compensation for the full economic and personal impact of their injuries. Recoverable damages typically include medical expenses, both current and future, lost wages, loss of earning capacity, and pain and suffering. In serious cases, compensation may also cover assistive equipment such as wheelchairs, home modifications, and personal vehicle adaptations required by the injury.

The value of a claim turns significantly on injury severity and prognosis. A plaintiff who is expected to make a full recovery will generally receive less compensation than one facing permanent disability or a lifetime of ongoing treatment. The more clearly your medical evidence establishes the long-term consequences of your injury, the stronger your position in settlement negotiations or at trial.
